Back child support can lead to felony charges

Furthermore, those who owe over $5,000 in unpaid child support or have more than one year of unpaid support could face felony charges if they leave the state or country to avoid child support obligations.

Child support is calculated by adding up the parents' combined incomes and splitting support proportionally between the parents. In other words, if the parents earn $6,000 and $4,000 per month, then their proportional support responsibilities will be 60% and 40%, respectively.

Unless your court order specifies a specific amount per child, the amount of child support you have to pay will remain the same until the order ends for all your children. Your child support order may end when a child turns 18, but also may continue up to the child's 23rd birthday, depending on the court's order.

If the support order is part of a “judgment,” a complaint for modification as well as a motion to reduce support must be filed and properly served on the other party before the court will consider changing the support order. Child support arrears cannot be forgiven by the court.

Is there a Massachusetts Statute of Limitation on Child Support? No, there is no statute of limitation on court-ordered child support for children under eighteen years. The order is still enforceable for past-due child support and retroactive child support even after the child attains maturity.

Other Key Changes in the New Massachusetts Guidelines

Additional changes raise the minimum guideline amount per week from $12 to $25 and provide for greater incremental increases in support for more than one child.

According to federal law, states must perform a quadrennial (every four years) review of their child support guidelines. In Massachusetts, this review was completed over the 2020-2021 year by the Child Support Guidelines Task Force, convened by Chief Justice of the Trial Court Paula M. Carey.
